A Special Town Meeting of the Electors was held on Thursday, November 9, 2006, in the Waubeka Firehouse meeting room, W4114 River Street, with Chairman, Richard Mueller calling the meeting to order at 7:35 p.m. TOWN OFFICIALS PRESENT: Chairman Mueller; Supervisors: Chris Janik, Lance Leider, Catherine Stern, James Stemper; Treasurer, Pam Duschene, Town Clerk Janis Stemper and Deputy Clerk, Dave Gorton. In addition to Town Officials, there were 23 citizens present. This hearing was held in compliance with the Open Meeting Law in that notice and the budget summary were posted in at least three public places in the Town and e-mailed to The Sounder, Ozaukee Press, and the Milwaukee Journal-Sentinel. The meeting notice was also published in the Ozaukee Press. The meeting notice and budget summary were also posted on the Town’s web site.

Chairman Mueller began the meeting by reading the agenda as it was posted.

Chairman Mueller read agenda item 1: BE IT RESOLVED that the electors of the Town of Fredonia hereby authorize the Town Board to donate $600 to the Fredonia Little League, in the year 2007, for the recreational benefit of the children of the Town who participate in this program, pursuant to St. Stats. 60.10(3)(b) & 60.23(3). There was a brief discussion of benefits of the Little League program. MOTION: Pat Jentges to approve; second Doug Winquist; carried.

Chairman Mueller read agenda item 2: BE IT RESOLVED that the electors of the Town of Fredonia hereby authorize the Town Board to donate $7500 to The National Flag Day Foundation, in the year 2007, to help fund their civic activities, pursuant to St. Stats. 60.10(3)(b) & 60.23(3). Theresa Kempfer provided a report on the activities of the Foundation. MOTION: Doug Winquist to approve; second LeeRaye Baumann; carried.

Chairman Mueller read agenda item 3: BE IT RESOLVED that the electors of the Town of Fredonia hereby authorize the Town Board to donate $500, in the year 2007, to the Ozaukee County Economic Development Corp. pursuant to St. Stats. 60.10(3)(b) & 60.23(3). MOTION: John Blasczyk to approve; second LeeRaye Baumann; carried.

Chairman Mueller read agenda item 4: Brief discussion regarding relocation the Town Hall. Chris Luft questioned why there were not other options on the referendum and expressed her opposition to a shared hall with the Village of Fredonia. John Blasczyk expressed his support of the shared hall, it makes sense.

Chairman Mueller read agenda item 5: BE IT RESOLVED that the electors of the Town of Fredonia hereby authorize the Town to exceed the limit of $5,000.00 per mile of Town roads for road maintenance and construction, in the year 2007. This is done pursuant to St. Stats. 81.01(3)(a). MOTION: Theresa Kempfer to approve; second John Blasczyk; carried.

Chairman Mueller read agenda item 6: BE IT RESOLVED that the Town tax levy for the Town of Fredonia for the year 2006, to be collected in the year 2006, shall be set at $324,857.00 pursuant to St. Stats. 60.10(1)(a). MOTION: John Blasczyk to approve; second Doug Winquist; carried.

A Public Hearing to hear comments for or against a request for a CONDITIONAL USE PERMIT was held on Thursday, September 14, 2006, in the Waubeka Firehouse meeting room, W4114 River Rd., with Chairman Mueller calling the hearing to order at 7:45 p.m.  TOWN OFFICIALS PRESENT:  Chairman Mueller, Supervisors: Chris Janik, Lance Leider, James Stemper, Clerk Janis Stemper, Treasurer Pam Duschene and Deputy Clerk, Dave Gorton.  ABSENT:  Catherine Stern.  This hearing was held in compliance with the Open Meeting Law in that notice was posted in at least three public places in the Town and e-mailed to THE SOUNDER, OZAUKEE PRESS, AND MILWAUKEE JOURNAL SENTINAL.  The Public Hearing notice was also published in the OZAUKEE PRESS, and was posted on the Town web site.  Adjoining lot owners were notified per Town Ordinance.

Chairman Mueller read the Conditional Use Permit requested by Ozaukee County for the land located along Hwy E North of Jay Road, Fredonia, WI, in the Town of Fredonia, the NW1/4 of the SW1/4 of Section 5, T 12 N, R 21 E, Town of Fredonia, Ozaukee County, Wisconsin, excepting that part depicted as C-1 on the official zoning map of the Town of Fredonia on September 14, 2006..

Chairman Mueller asked if there were any questions or comments.  Mr. Jim Dingman requested the hours of operation be changed to reduce the problems of early morning noise.  He asked that the start time be set at 7:00 A.M. and screening to not start before 8:00 A.M. Mrs. Kate Dingman also requested the starting times be changed.

Chairman Mueller asked if there were any questions or comments.  Mr. Jim Dingman objected to the proposed change stating the C-2 area should stay C-2 to preserve the rural nature and to preserve the wildlife of the area.  Mrs. Kate Dingman also stated her objections to the change from C-2 to M-3.

A Public Hearing to hear comments for or against a request to correct a Town Zoning Map error on property owned by Laura Hurias from C-1 to C-1 & C-2 in Section 22, proposed lot east of her 5 acre home parcel at W3727 Belgium Kohler Rd. was held on Thursday, May 11, 2006, in the Waubeka Firehouse meeting room, W4114 River Rd. with Chairman Mueller calling the hearing to order at 7:30 p.m. followed by the Pledge of Allegiance.  OFFICIALS PRESENT:  Chairman Mueller, Supervisors: Chris Janik, Lance Leider, James Stemper, Catherine Stern, Clerk, Janis Stemper and Deputy Clerk, Margaret Rabuck.  This hearing was held in compliance with the Open Meeting Law in that notice was posted in at least three public places in the Town and e-mailed to THE SOUNDER, OZAUKEE PRESS, AND MILWAUKEE JOURNAL SENTINEL.  The Public Hearing Notice was also published in the OZAUKEE PRESS, and posted on the Town web site.

APRIL 10, 2006

The Annual Meeting of the Town of Fredonia was held on Monday evening April 10, 2006 in the Waubeka Firehouse meeting room, W4114 River Street, with Chairman Mueller calling the meeting to order at 8:05 p.m. Town Officials present: Chairman Mueller, Supervisors: Chris Janik, Lance Leider, Catherine Stern, Treasurer, Tom Sauer and Deputy Clerk, Margaret Rabuck. This meeting was held in compliance with the Open Meeting Law in that copies of the meeting notice were posted in at least three public places in the Town and e-mailed to the SOUNDER, OZAUKEE PRESS AND THE MILWAUKEE JOURNAL-SENTINEL. Notices had also been published in the Ozaukee Press. In addition to the Town Officials thirty-one (31) Town residents were present for all or part of this meeting.

The Deputy Clerk read the minutes of the April 18, 2005 Annual Meeting. MOTION Rose Leider, second Steve Paulus to approve the minutes as read; carried. The date for the next Annual Meeting was scheduled for Monday, April 16, 2007 at 8:00 p.m. Question arose as to changing meeting time to 7:30 p.m. rather than 8:00 p.m. Residents agreed with the earlier start time. MOTION Bob Lederer; to schedule Annual Town Meeting for Monday, April 16, 2007 at 7:30 p.m.; second Tom Curtis; carried.

Peter Wagner, Chief of the Waubeka Fire Department reported that during the year 2005 there were 25 fire calls and 56 EMS calls. A total of 102 Fire Inspections were conducted. Chief Wagner further advised that the fire sirens will be activated the first Saturday of each month for tornado awareness and the safety of Town residents. He advised that both sirens appear to be working. Wagner also advised the department had 5800 hours of training for their personnel and as of June 2005 they began transports of patients to hospitals in the area. Wagner also stated that a sign will be placed at the corner of Hwy A & Hwy H which will display fire prevention messages. Asst. Chief James Behrens advised residents on Grants and stated the department has written a total of 4 Grants with the most recent being for the installation of an exhaust system to eliminate gas and diesel fumes when the trucks are being reset for service.

Chairman Mueller reviewed the 2006 Budget with the residents and advised that the tax levy was set at $318,490.00 which represents a 3 per cent increase. Tom Curtis questioned use of surplus and whether or not taxes will be reduced. Mueller advised that the checks received from the State are received later in the year and we have to operate with the budget that is presently in effect. He also advised that the State did cut Revenue Sharing to all communities. Mueller stated the State sets the levy at 2.2 percent and municipalities cannot exceed the 3 per cent limit. Mueller advised that a great deal of the budget is spent on road repairs and snow plowing when needed. A question was asked as to how many gravel roads still remain within the Township. Road names mentioned were those of Fairway Dr. and Willow Valley Rd.

Any other Old Business: No response received.

New Business: Mueller advised Town Residents that new Fire numbers will be erected throughout the Township to aid the Fire Department in emergency situations. Samples were passed around to the residents for their review and opinions. Two separate companies submitted proposals to the Board prior to this meeting. Residents agreed to the 8" blue sign with Town of Fredonia inscribed on the top of the sign being furnished at no extra charge. The residents also agreed to mount the Fire Number on a galvanized pole. The life expectancy is approximately 10 years. Tom Curtis questioned why the Town name has to be on the sign. Mueller said this is an important factor especially when you’re close to another municipality. Peter Wagner advised the blue sign is highly visible at night. The installation of the signs would be included in the price from Lange Enterprises, whereas Tapco would only make the signs and we would have to provide installation. The Town would bear the initial cost of installing the signs at each residence in the Township. If the sign is damaged or removed, the property owner will be responsible for replacement. The cost of the signs including installation is approximately $24,000.00. MOTION Patrick Jentges to purchase the blue sign with 8" numerals and the Township name mounted on a galvanized post; second Russell Saueressign; carried; One "no" vote was cast.

Robert Lederer, Chairman of the Town Hall Building Committee introduced members of the Committee, Lance Leider, Bruce Paape, Jim Stemper and Carol Mueller, Town Clerk or Margaret Rabuck, Deputy Clerk. It was determined that there was not sufficient space to add onto the present Fire Department Building and still be able to have ample parking especially for elections. Further handicapped accessible buildings are a State Mandate. Several property owners within the area were contacted regarding selling land to the Township for this structure. Some of the property owners were not interested in selling at this time and others had a higher cost factor involved. Land was offered for sale at the Americanism Center and after much discussion it was determined by the Committee to recommend that location for construction of the Town Hall. Mike Kroeger, a resident of the area expressed concern about the building obstructing his view from his residence. Bruce Paape displayed to residents the roads in the area and the approximate location of the building. He indicated that there would be a separate driveway and stated the building would be erected on the west lot line. Questions arose as to why not construct the building on the east side of the driveway. Mueller advised there would be a great deal of fill that would be required if this site were used. Rabuck stressed the need for safe storage of town records in one specific area. Tom Curtis questioned why storage space couldn’t be rented for this purpose. Mueller stated records must be kept close at hand for research when a question is posed. Curtis asked why Americanism Center couldn’t be refurbished to accommodate the needs of the Township. Paape responded it would cost more to rehab than to build. Mueller further stated our own building would be more user friendly. Rose Leider stated that a plan for our own building is good and that all documents should be close at hand. Bob Lederer concluded the presentation citing that the Town has been in existence since 1847 and all we have to show is a Recycling Center. Mueller advised Town should secure loan for a 20 year period rather than 10 years. Mike Kroeger wants building erected a greater distance from the roadway at the Americanism Center. Steve Paulus stated the building should be out of town. Cost estimate figures are approximately $375,000.00 including the parking lot. Bruce Paape states electrical, plumbing, etc should be bid out. Steve Paulus stated Town should receive dollar amount before proceeding. The "Public Use" of the building was questioned. This will be discussed in more detail at a later date. Peter Wagner questioned the hiring of an architect. Bob Lederer responded that many builders now have their own architects that are included in the building package. The Building Committee was asked to search for plans to be presented at another meeting. LeeRaye Baumann asked for site approval. MOTION LeeRaye Baumann to approve site at Americanism Center for construction of a Town Hall; second Steve Paulus; carried. One "no" vote was cast.

Mueller advised there will be a meeting at the County on April 27, 2006 regarding Flood Control. Teresa Kempfer asked what happened to the DNR planting environmentally friendly plants in the Milwaukee River area at the site of the dam removal. She advised all that is growing at the present time is noxious weeds. Mueller responded he believes they are waiting more settling in the area.

Bruce Paape requested a lower speed limit on River Road and School Road. Mueller responded that it is a very difficult procedure in procuring a lower speed limit. Steve Paulus stated that the Town should hire a Traffic Officer and have tickets issued.

Bob Behrens advised several tires have been abandoned on the roadways by unknown parties.

JANUARY 12, 2006

A Public Hearing to hear comments for or against a request for a Conditional Use Permit from Chad Uselding, DBA CRC Hobbies LLC, at W3982 Hwy H, to construct and operate a hobby car race track at the above location which is zoned B-2 was held on Thursday, January 12, 2006, in the Waubeka Firehouse meeting room, W4114 River Rd., with Chairiman Mueller calling the hearing to order at 7:30 p.m. OFFICIALS PRESENT: Chairman Mueller, Supervisors: Chris Janik, Lance Leider, James Stemper, Catherine Stern, Treasurer Tom Sauer, and Deputy Clerk, Margaret Rabuck. This hearing was held in compliance with the Open Meeting Law in that notice was posted in at least three public places in the Town and e-mailed to THE SOUNDER, OZAUKEE PRESS, AND MILWAUKEE JOURNAL SENTINEL. The Public Hearing Notice was also published in the OZAUKEE PRESS, and was posted on the Town web site.

In addition to Town Officials there were 42 town residents present and reporters from the Ozaukee Press and Sounder.

Chairman Mueller read the Conditions of the Conditional Use Permit.

Chairman Mueller requested the Deputy Clerk to read the names of people notified reference this hearing.

Attorney Brian Mularski appeared with ‘Chad Uselding. Attorney Mularski states the track would be constructed for approximately 8 to 10 cars per race. Mularski further states they will work with the Town reference noise. Jane Kozma appeared and stated she is not against Uselding having a business but is very concerned about the noise level and property values in this area should a track be constructed. She stated further this would disrupt any quality time spent outdoors on the weekends. Paul Kozma appeared and stated he wanted sound levels tested. Mularski advised the sound level is quite different between indoor and outdoor race tracks and further advises the track would be constructed of special materials along with a berm which would send the noise upward. Mularksi further stated the property is zoned properly for a business. Stemper said he has heard these race cars and the sound is not that loud. Paul and Jane Kozma stated they want an indoor track constructed to maintain quiet and property values. Christine Luft appeared and stated this track is not compatible with the subdivision and that the requests of residents should be considered.

Gary Uselding appeared and advised this is not a daily event and this is excellent family recreation. John Blasczyk appeared and advised he has a track in his back yard and the children enjoyed the sport. He further advised he had no problems. Jan Stadler appeared and stated she did not hear anything. Catherine Stern, Board Member said that she attended the WI State Fair on two separate days to view the miniature race cars and said she was not bothered by the noise as she could hear calls on her cell phone. Laura Berweger appeared and says she’s in favor of this proposed business.

Ellie Uselding appeared and stated she has observed children and families and the excitement involved in these events.

Doug Davis appeared and made reference to his letter in the January 12, 2006 issue of the Ozaukee Press. He further stated this is wonderful family entertainment.

Jane Kozma advised she was against the late hour of operation, that being 9:00 p.m.., and requested an earlier finish time. Mularski advised weekend hours are the family time

hours in which these races can only be run. Chad Uselding appeared and responded that each race is approximately 3 to 5 minutes in length and there is a lapse time between races.

Stemper suggested that a review could be conducted in several months to ensure all conditions are being met. Mularski and Uselding were in agreement.

Mueller advised he received several letters from supporters of the track.

A Public Hearing to hear comments for or against a request by the Town to rezone the following described properties on Hwy H: Big Joe’s, Fredonia Automotive and Schawi’s from M-2 to B-2, Ordinance 2005-6 was held on Thursday, December 8, 2005, in the Waubeka Firehouse meeting room, W4114 River Rd., with Chairman Mueller calling the hearing to order at 7:30 p.m. OFFICIALS PRESENT: Chmn Mueller, Supervisors: Chris Janik, Lance Leider, James Stemper, Catherine Stern and Treasurer, Tom Sauer, and Deputy Clerk Margaret Rabuck. This hearing was held in compliance with the Open Meeting Law in that notice was posted in at least three public places in the Town and e-mailed to THE SOUNDER, OZAUKEE PRESS, AND MILWAUKEE JOURNAL SENTINEL. The Public Hearing Notice was also published in the OZAUKEE PRESS, and was posted on the Town web site.

In addition to Town Officials there were 7 town residents present and a reporter from the Sounder.

Chairman Mueller read the proposed Ordinance 2005-6 to rezone from M-2 to B-2, the following business locations W3940, W3970, and W3980 Hwy H, tax key numbers 04-028-16-001.00, 04-028-16-002.00, and 04-028-16-004.00, to reflect the current and past use, and to correct the zoning map, at the request of the Town Board and following recommendation by the Plan Commission.

Chairman Mueller requested the Deputy Clerk to read the names of people notified reference this hearing.

Joel Schneider of Big Joe’s questioned what effect this would have on property taxes. He was advised none whatsoever.

PUBLIC HEARING ON THE 2006 PROPOSED BUDGET

A Public Hearing on the proposed 2006 budget was held on Thursday evening, November 10, 2005, in the Waubeka Firehouse meeting room, W4114 River Street with Chairman Richard Mueller calling the hearing to order at 7:30 p.m. TOWN OFFICIALS PRESENT: Chairman Mueller; Supervisors: Chris Janik, Lance Leider, Catherine Stern, James Stemper; Treasurer, Tom Sauer; Deputy Clerk, Margaret Rabuck. This hearing was held in compliance with the Open Meeting Law in that notice was posted in at least three public places in the Town and e-mailed to THE SOUNDER, OZAUKEE PRESS, AND MILWAUKEE JOURNAL-SENTINEL. The Public Hearing notice was also published in the OZAUKEE PRESS, and was posted on the Town Web site.

In addition to Town Officials, there were 20 Town residents present, along with a reporter from The Sounder.

Chairman Mueller gave a brief explanation of the revenues and disbursements in the proposed budget, explaining the reason for any major increases or decreases. The Town Tax Levy proposed is $318,490 which reflects a 3% increase over last year. John Blasczyk questioned the levy and why some of the general fund balance was not used to lower the levy. Mueller responded the majority of the increase is due to the cost of highway improvements on Town roads, and the general fund balance is needed to meet any unanticipated costs, emergencies, or possible increased highway expenses due to snowstorms etc. A reasonable general fund balance is also required for cash flow as the Town does not receive the majority of its State aids (Shared Revenue funds) until late in November.

Mueller asked several more times if there were any other public comments or questions and there were none.

Chairman Mueller read the proposed Ordinance as follows: as requested by Roger Mayhew, W4535 Hwy A, Section 32, a 13+ (CSM now indicates 12.93 ac) acre parcel (with home and buildings), to be split off of his 60 acre parcel, to be rezoned to A-3; balance to remain zoned A-1.

Chairman Mueller asked the Clerk to read the names of the people notified of the rezone.

Chairman Mueller asked if there were any questions. John Goelzer, a neighbor asked where the 330 foot frontage would be placed. He was advised that there was 330’ of frontage on the west end of the remaining parcel (now Lot 2), and 655 ‘of frontage to the east of that on the new parcel (Lot 1).

Chairman Mueller explained the proposed Ordinance as follows: Section 19, parcels owned by John Witta, N6010 Riverside Rd., 10 acs,; Anthony Bernier, N6020 Riverside Rd., 10 acs.; Charles Weyker, N5970 Riverside Rd. (two parcels) 6.56 acs and 8.45 acs.; Clifford Baumann, N5918 Riverside Rd., 12 acs. The first approximate 500 ft. of each parcel, from the road eastward, is now zoned R-2 with the balance of each parcel zoned A-2. The Town Plan Commission recommends that the first 500 ft. shall be rezoned to A-2, to bring the lots into conformity and eliminate the mixed zoning on these parcels. This rezone was initiated by the Town.

Chairman Mueller asked the Deputy Clerk to read the names of the people notified.

Chairman Mueller asked if there were any questions or comments. Anthony Bernier, one of the property owners stated he was in favor of the rezone.

A Public Hearing to hear comments, for or against, proposed ORDINANCE 2005-3, an Ordinance to amend Section 17.07(4), A-1 Exclusive Agricultural District Conditional Uses, by adding: (h) wind towers/turbines and wind energy facilities, was held on Thursday, July 14, 2005 in the Waubeka Firehouse meeting room, W4114 River Rd. with Chairman Mueller calling the hearing to order at 7:30 p.m. followed by the Pledge of Allegiance. Chairman Mueller asked if there were any public comments or questions. Attorney Ed Ritger appeared and displayed a map of where the tower would be located. He stated the tower would be approximately 430 feet in height and would generate power to a sub-station which could ultimately provide power for 400 to 600 homes. WE Energies would purchase the power generated. Jeff Schaut questioned the distance required between towers. He was advised that wind velocity determines distance so as to avoid turbulence and wakes. Gary Locklair asked if the height of the tower included from base to tip of blade. He was advised this was the total height. He was further advised that only one tower could be placed on a 40 acre parcel. He also expressed concern about noise. He was advised the towers emit approximately 50 decibels which is equal to a refrigerator compressor. Attorney Ritger offered a tour to an existing wind farm to anyone present. Attorney Ritger further advised there is no contract with WE Energies as of this date as they are awaiting a decision from the Public Service Commission regarding rate hikes. Construction of the tower may not occur until 2006.

Chairman Mueller read the terms of the Conditional Use Permit requested for expansion of the existing campground by the construction and use of a lodge to accommodate approximately 80 guests for occasional overnight stays, which are as follows:

  • All applicable State regulations regarding this type of building and use shall be enforced.

  • The roadway leading to the lodge shall be adequate for fire and/or rescue vehicles accessibility.

  • When overnight guests are present, a sufficient number of adult JCC employees shall remain onsite to facilitate response, and, if necessary, evacuation, in the event of any emergency.

  • The use of the new lodge will constitute only occasional overnight use, and will not be used as a permanent residence.

  • Noise and traffic shall be limited so as not to disturb any neighbors.

  • Any/all signage shall comply with applicable Town Ordinances.

In addition, the Permittees shall reimburse the Town for any legal fees, publication costs and recording fees incurred by the Town with respect to the issuance of this permit.

Richard Gattoni Jr. representing the JCC Rainbow Day Camp appeared and advised the Board that the lodge would have occasional use only.

APRIL 18, 2005

The Annual Meeting of the Town of Fredonia was held on Monday evening, April 18, 2005 in the Waubeka Firehouse meeting room, W4114 River Street, with Chairman Richard Mueller calling the meeting to order at 8:00 p.m. Town Officials present: Chairman Mueller, Supervisors: Chris Janik, Lance Leider, Catherine Stern, James Stemper, Treasurer, Tom Sauer and Deputy Clerk Margaret Rabuck. This meeting was held in compliance with the Open Meeting Law in that copies of the meeting notice were posted in at least three public places in the Town and e-mailed to the SOUNDER, OZAUKEE PRESS AND THE MILWAUKEE JOURNAL-SENTINEL. Notices had also been published in the Ozaukee Press. In addition to the Town Officials ten (10) Town residents were present for all or part of this meeting.

The Deputy Clerk read the minutes of the April 19, 2004, Annual Meeting. MOTION Rose Leider, second Harry Michaels, to approve the minutes as read; carried. The date for the next Annual Meeting was set for Monday, April 10, 2006 at 8:00 p.m. MOTION Teresa Kempfer, second Peter Wagner, and carried.

Chief Peter Wagner of the Waubeka Fire Department was present and advised that during 2004 there were 22 fire calls and 52 EMS calls for a total of 6000 hours. Two new members were added to the Department during 2004. In addition to emergencies, there were 125 fire inspections. Chief Wagner advised that the fire siren will be activated the first Saturday of each month for tornado awareness and the safety of Town residents. Chief Wagner advised the siren on Hwy H heading south to Little Kohler needs to be repaired. Chief Wagner also cautioned residents of the danger in burning grass, etc. due to the present dry conditions. Safety and common sense must prevail. Chief Wagner noted the Fire Dept. received a total of $161,000.00 in grant money which was used for the purchase of 18 air packs in 2004, with the remainder of this money to be used for exhaust equipment in the Fire Dept. bay area to eliminate gas and diesel fumes when the trucks are being reset for service.

Chairman Mueller reviewed the Town’s annual financial report explaining some of the 2004 revenues and disbursements. Christine Luft questioned the increase in the dollar amounts from the sale of recyclables in ’04, which had tripled from that of ‘03. Mueller explained that prices were higher for plastic and cardboard, and some bales had been held for over a year.

Teresa Kempfer appeared on behalf of the Americanism Center and advised that the theme for the 2005 Flag Day Celebration will be to honor all WWII veterans. The Flag Day Celebration is scheduled for Sunday, June 12, 2005. Kempfer further advised that all the rooms at the Americanism Center are being used, with some groups having to share a room. The Center is working to pay off the remaining mortgage on the building.

Chairman Mueller spoke on road repairs. The TRIP fund project for this year will be Hickory Grove Road, from Hwy K to STH 57. Mueller noted that Center St in Waubeka, which was repaired and paved in 2004, had a higher cost than originally anticipated.

Chairman Mueller stated that our lease with the Waubeka Fire Department, for the use of the Town Hall and the Town’s office area, will be expiring in November of this year and the Town will need to find a new location for meetings and office space. All Town residents will be notified, and a special meeting scheduled, to discuss this issue after more information has been gathered.

Teresa Kempfer asked if the new/recodified Ordinances had been adopted. She was advised they were and that they are posted on the Internet. The question also arose as to enforcement of the Ordinances. We don’t have an enforcement officer, but Town Board Members can enforce all Ordinances.

Jamie Behrens questioned a speed machine located on Hwy A, west of Waubeka, near Waubedonia Park, in early April. Behrens said the machine did not appear to be operating. Town officials were unaware of this; it would be a County issue.

Christine Luft questioned if Robert Lederer’s appointment as Culvert Inspector would be a conflict of interest, as he is also a Plan Commission Member. She was advised this was not a conflict. Chairman Mueller thanked former inspector, Roger Janke, for his years of service to the Town.

Chairman Mueller noted that Supervisor, Ellie Doyle, had resigned last year. He stated that she was missed, thanked her for her years of dedicated service, and wished her well in all future endeavors.

Pat Bialzik questioned the Board about the old truck parked across the road from her residence, on the Stageman property on Hwy I, and asked if this was in violation of our present ordinances. The issue will be placed on the next Board meeting agenda to determine if there is a violation of current ordinances, and what can/should be done about it.

Chief Peter Wagner expressed concern about the Town’s fire numbers. He said they are difficult to read and this could be crucial in emergency situations. He advocated numbers being visible from both sides. Wagner will do some research and present information to the Board for further action.

FEBRUARY 10, 2005

PUBLIC HEARING TO CONSIDER ADOPTION OF CHAPTER 17, ZONING CODE, AND CHAPTER 18, SUBDIVISION AND PLATTING, OF THE TOWN OF FREDONIA CODE OF ORDINANCES

A Public Hearing on the Adoption of Chapter 17, Zoning Code and Chapter 18, Subdivision and Platting, of the Town of Fredonia Code of Ordinances was held on THURSDAY, FEBRUARY 10, 2005, in the Waubeka Firehouse meeting room, W4114 River Street, with Chairman Richard Mueller calling the hearing to order at 7:31 p.m., followed by the Pledge of Allegiance. TOWN OFFICIALS PRESENT: Chmn. Mueller, Supervisors: Chris Janik, Lance Leider, Catherine Stern, James Stemper; Town Attorney Jerry Edgar, Treasurer Tom Sauer, and Deputy Clerk Margaret Rabuck. This hearing was held in compliance with the Open Meeting Law in that notice was posted in at least three public places in the Town and e-mailed to THE SOUNDER, OZAUKEE PRESS AND MILWAUKEE JOURNAL SENTINEL. The PH notice was published in the OZAUKEE PRESS, and was posted on the Town’s website. In addition to Town Officials there were 19 Town Residents present, and reporters from the Ozaukee Press and The Sounder.

Chairman Mueller explained this hearing was being held on Chapter 17 and 18, as these were the only chapters that required a Public Hearing prior to adoption.

Residents were upset that ordinances could not be printed off the Town web site. It was noted they were able to print Ordinances from other communities in the county. Questions as to why no historic district was created. Response by Attorney Edgar that historic districts must be created through the state and the only area affected would be the Village of Waubeka and that could be questionable. Mueller stated guidelines must be followed and any changes made on properties would have to be approved by the state. Questions were asked as to what defines a Farm Service Business. Chairman Mueller explained it was a product or service that is located in the A1 or A2 districts and is of service to the Ag. industry. Questions were also asked by residents about Farm Consolidation. Responses were made by Attorney Edgar and Mueller.

Questions were also asked about Chapter 18. It was noted that Chapter 18 deals primarily with land divisions and subdivisions. Attorney Edgar explained that the process is more clearly defined than in the previous Ordinance 13. Comments were expressed by residents as to property owner rights regarding proposed subdivisions or zoning changes in their area. Attorney Edgar and Mueller both stated that a zoning request had to be made by the property owner. If the zoning committee approved, it would go to a public hearing, at which time adjacent property owners would be notified by mail and have a right to protest the proposed zoning. Sally Fritzsch, a prospective buyer of a residence in the town, had questions about the home being used as a CLA (community living arrangement) for older adults who required assistance, and also about why adult day care was not mentioned in the ordinances, whereas child day care was.

Some residents felt proposed ordinances should not be approved until all questions were resolved. Chairman Mueller stated the board would like to adopt ordinances as presented; any changes or additions could be addressed in the future as needed. Without adoption, ordinances could not be enforced. Questions were addressed as to highway access. Response by Mueller that Town has jurisdiction over Town Roads; County Roads are governed by the County.

PUBLIC HEARING ON THE 2005 PROPOSED BUDGET

A Public Hearing on the proposed 2005 budget was held on Thursday evening, November 11, 2004, in the Waubeka Firehouse meeting room, W4114 River Street with Chairman Richard Mueller calling the hearing to order at 7:30 p.m. TOWN OFFICIALS PRESENT: Chairman Mueller; Supervisors: Chris Janik, Lance Leider, James Stemper; Treasurer, Tom Sauer; Deputy Clerk, Margaret A. Rabuck. ABSENT: Catherine Stern. This hearing was held in compliance with the Open Meeting Law in that notice was posted in at least three public places in the Town and e-mailed to the SOUNDER, OZAUKEE PRESS, AND MILWAUKEE JOURNAL SENTINEL. The Public Hearing notice was also published in the OZAUKEE PRESS, and was posted on the Town web site.

In addition to Town Officials, there were 11 Town residents present, along with reporters from the Ozaukee Press and The Sounder.

Chairman Mueller gave a brief explanation of the sources of revenues and disbursements in the proposed budget, explaining the reason for any major increases or decreases.

Mueller asked several times if there were any public comments or questions and there were none.

The Chairman read the NOTICE OF PUBLIC HEARING as it had been posted and published: NOTICE IS HEREBY GIVEN that the Town Board of the Town of Fredonia will hold a Public Hearing on October 14, 2004, at 7:30 p.m. at the Town Hall, W4114 River Road, for the purpose of considering an ordinance to amend the Town Zoning Map, as requested by Mike & Sue Borchardt, to rezone their lot/building at W4139 Center St, Waubeka from R-4 to B-1(its historical use has been B-1). Comments for or against this proposal by all interested persons, their agents or attorney will be heard.

SEPTEMBER 30, 2004

SPECIAL TOWN MEETING OF THE ELECTORS

A Special Town Meeting of the Electors was called by the Town Board of the Town of Fredonia and was held on Thurs.,Sept.30,2004 at 7:30 p.m. Town Board members present were Chairman Mueller, Chris Janik, Lance Leider and Jim Stemper; Cathy Stern was unable to attend; Treasurer Tom Sauer and Deputy Clerk Marge Rabuck were also present.

The Chairman opened the meeting with the Pledge of Allegiance.

The purpose of this meeting, as it was published and posted, was to authorize spending in excess of the allowable rate per mile for maintaining Town roads, and to approve an authorizing resolution to transfer funds from the General Fund to the Road Maintenance Fund for this purpose.

Chairman Mueller read this authorizing Resolution:

BE IT RESOLVED that the electors of the Town of Fredonia, gathered at this Special Town Meeting of the Electors, on September 30, 2004, hereby authorize transferring funds from the General Fund and the Contingency Fund to the Road Maintenance Fund to cover the road maintenance expenses for the balance of 2004, which will, due to unexpected charges, road, and weather conditions, exceed the State authorized limit of $5,000 per town highway mile. In no case will funds be transferred to exceed the General Fund or Contingency Fund balances expected/budgeted for 2004. In other words, no borrowing will take place to meet the road maintenance expenses. This Resolution is for the year 2004 budget only. This is done pursuant to St. St. 81.01(3(a).

Discussion by Board members as to how much money needed to be transferred and reasons for going over budget. Besides the Treasurer and Deputy Clerk, no other Town residents appeared to discuss this issue. MOTION Stemper, second Janik, to adopt the resolution above, as read; motion carried 6-0, with all present voting in favor. The Resolution will take effect following posting of same.

NOTICE IS HEREBY GIVEN that the Town Board of the Town of Fredonia will hold a Public Hearing on September 9, 2004 at 7:30 p.m. at the Town Hall located at W4114 River Road for the purpose of considering the granting of a Conditional Use Permit to Kenyon and Sue Ann Rose, a/k/a Ramblin’ Rose Auction Co., 316 Judge Dr., Saukville, WI, 53080, for the operation of auction sales at N5472 Cigrand Dr., Fredonia, WI, 53021. All interested persons, and/or their agents and attorneys will be heard.

The Clerk read the list of adjoining lot owners who were sent notification of this Hearing. Chairman Mueller read Conditional Use Permit and asked for questions or comments.

Christine Luft expressed concerns about parking, news article stated room for 55 cars at auction location. Other concerns were that of on street parking and interfering with Sunday worship services at neighboring churches and outdoor activities for neighboring residents. Intersection of Co Hwy Z and H was also a concern as to diminished visibility with high traffic pattern during an auction.

Rose said he has a verbal agreement with the County for parking in their lot across the street. He stated that signs would be posted advising no parking near the church until after 11:00 a.m. on Sunday auctions. Rose said if a large number of items are on the auction block the location would be moved to Circle B.

Carol Dobberpuhl was concerned about the square footage of the building and adequate restroom facilities. She also was concerned about parking for property owners in the area.

Rose responded that the square footage of the building is 3500 sq. ft. and restroom facilities are addressed.

John Feltes expressed concerns about parking as the streets are narrow and could hinder snow removal in winter; littering in the area, along with noise, were other concerns. He said the Fire Department refuels at the Highway Shop across the street where overflow auction patrons would park and this may cause a problem in an emergency situation. Feltes felt lights and signs in the neighborhood are/may be inappropriate.

Response by Rose is that these issues were addressed at the last 3 meetings. There would be no outside flashing lights, no loud speakers and only 1 outside sign with a spotlight is possible. Response by Mr. Feltes is that the granting of the Conditional Use Permit will impact the community.

Mueller, and Treasurer Tom Sauer. In addition to Town Officials, there were seven Town residents present, along with reporters from the Ozaukee Press and The Sounder. This hearing was held in compliance with the Open Meeting Law in that the notice and the budget summary were posted in at least three public places in the Town and e-mailed to The Sounder, Ozaukee Press, and Milwaukee Journal-Sentinel. The meeting notice was also published in Ozaukee Press. The meeting notices and budget summary were also posted on the Town’s web site.

Chairman Mueller read the notice as it was posted.

Chairman Mueller read the following Resolution: BE IT RESOLVED that the electors of the Town of Fredonia hereby authorize the Town Board to donate $600 to the Fredonia Little League, in the year 2004, for the recreational benefit of the children of the Town who participate in this program; pursuant to St. St. 60.10(3)(b) & 60.23(3(a).

Discussion: Theresa Kempfer asked if this is the same amount as last year’s donation…it is.

MOTION Theresa Kempfer, second George Maechtle, to adopt the Resolution as read; carried on a voice vote, with all present in favor.

Chairman Mueller next read the following Resolution: BE IT RESOLVED that the electors of the Town of Fredonia hereby authorize the Town Board to donate $500 in the year 2004, to The Ozaukee County Economic Development Corp. pursuant to 60.23(3) Wis. Stats.

Discussion: The Clerk noted that a letter was received from the OCEDC asking that the $500 donation be made again this year, and thanking the Town for last year’s donation.

MOTION Theresa Kempfer, second Ron Stadler, to adopt the Resolution as read; carried on a voice vote, with all present in favor.

Chairman Mueller next read the following Resolution: BE IT RESOLVED that the electors of the Town of Fredonia hereby authorize the Town Board to donate $7500 to The National Flag Day Foundation, in the year 2004, to help fund their civic activities; pursuant to St. St. 60.10(3)(b) & 60.23(3(a).

Discussion: Theresa Kempfer read a brief note from Jack Janik, asking that the Town continue to support their efforts concerning Flag Day and the Americanism Center, and thanking the Town for past contributions. Kempfer also noted some of the recent accomplishments and goals at the Center and the completion of the Historic walking trail.

MOTION Carol Mueller, second Tom Sauer, to adopt the Resolution as read; carried on a voice vote, with all present in favor.

Chairman Mueller next read the following Resolution: BE IT RESOLVED that the Town tax levy for the Town of Fredonia for the year 2003, to be collected in the year 2004, shall be set at $305,000 pursuant to St. St. 60.10(1)(a).

Approximately 2 acres of the property is to be used for this purpose; area is zoned M-3. All interested persons, their agents and attorneys will be heard.

Tim Zignego was present and explained that his company has a contract to provide concrete for the new power plant in Port Washington. They will be moving their temporary concrete plant now located on Hwy 57 at Cty A & H, when the Hwy 57 project is completed.

NOTICE IS HEREBY GIVEN that the Town Board of the Town of Fredonia will hold a Public Hearing on January 9, 2003 at 7:30 p.m. at the Town Hall, W4114 River Rd., for the purpose of amending Sec. 3.04, A-2 Agricultural/Rural Residential District, of the Town Zoning Ordinance to add the following conditional use: Farm service businesses which do not include merchandise sales and are not detrimental to the enjoyment of adjoining property. All interested persons, their agents and attorneys will be heard.

The Chairman asked for public comments. Hank Nask asked what farm services were being added and what conditional uses were allowed currently under the A-2 Ordinance. Janik read the list and noted that each would need to be considered individually, and a Public Hearing would be held, before any conditional use is permitted.

The Chairman asked twice again for comments and with there being none, MOTION Janik, second Leider to close this Public Hearing; carried.

2. The Chairman read the notice of this second Public Hearing as it had been posted and published:

NOTICE IS HEREBY GIVEN that the Town Board of the Town of Fredonia will hold a Public Hearing on January 9, 2003 at 7:45 p.m. at the Town Hall, W4114 River Rd., for the purpose of considering the granting of a conditional use permit to Jeff Bobholz, 1111 E. Kilbourn Ave., West Bend, to permit the repair of farm vehicles, machinery and equipment at N7000 Camp Awana Rd., Fredonia. All interested persons, their agents and attorneys will be heard.

The Chairman asked several times for comments from the public, and there were none. MOTION Stern, second Leider to close this Public Hearing; carried.
