The Legislative Committee met in Room A-200 at 8:45 A.M.

Meeting called to order by Acting Chairperson Pape.

Present: Supervisors Pape, Wirth, Smith, Brooks, Administrative Coordinator Meaux and County Clerk Marchese.

Absent: Supervisor McCulloch.

Discussion regarding Resolution No. 03-63 - Stadium Sales Tax. Motion made by Mr. Brooks, seconded by Mrs. Pape, to support the resolution. Discussion regarding the ending date and how it could affect Ozaukee County. All members present voting aye, the motion was declared adopted.

Discussion regarding Resolution No. 03-65 - Support State Legislation to Establish County Government Fees Relating to Private Onsite - Wastewater Treatment Systems as a Special Charge. Motion made by Mr. Brooks, seconded by Mrs. Smith, to support the resolution. Discussion how this would affect individuals and municipalities. All members present voting aye, the motion was declared adopted.

At 8:55 A.M., Meeting declared adjourned.

The Legislative Committee met in Room A-200 at 8:45 A.M. prior to the County Board session.

Meeting called to order by Acting Chairperson Pape.

Present: Supervisors Pape, Wirth, Brooks, Smith, and County Clerk Marchese.

Absent: Supervisor McCulloch

A resolution from Outagamie County regarding a Constitutional Amendment to change county officials from an elected position to an appointed position.

8:47 A.M. - Supervisor McCulloch now present.

Motion made by Mrs. Smith, seconded by Mr. Brooks, to go on record as opposing the Amendment. Discussion regarding reasons of being opposed to the change was presented. All members present voting aye, the motion was declared adopted.

Resolution No. 03-42 - Oppose Constitutional Amendment was reviewed and there was discussion regarding favoring the presentation of the resolution to the County Board. Motion made by Mrs. Smith and seconded by Ms. McCulloch to approve the resolution. All members voting aye, the motion was declared adopted.

At 8:49 A.M. meeting was declared adjourned.

Meeting called to order by Chairperson McCulloch. 

Present:      Supervisors McCulloch, Wirth, Brooks, Smith, and County Clerk Marchese. 

Absent:      Supervisor Pape 

Resolution No. 03-28 - Opposing The Proposed Property Tax Freeze was reviewed and there was discussion regarding opposition to the presentation of the resolution as to the effects at local and state level.  Motion made by Mr. Brooks and seconded by Mrs. Smith to approve the resolution.  The vote was taken:  (Ayes – Brooks & Smith, Nays-Wirth)  The majority voting aye, the motion carried.

Present: Chairman Wirth, County Supervisors, Bernadyne Pape, Katie Smith, Robert Brooks, Kim McCulloch, Administrative Coordinator Tom Meaux, County Clerk Mary Marchese, Deputy Treasurer Kathy Everix, and Jason Dzwinel

Meeting called to order at 8:40 a.m. by Chairman McCulloch

Resolution 03-24 Late Payment of Property Tax Installments was presented and reviewed by the Committee. Motion made by Ms. Pape to approve as presented, seconded by Ms. Smith. Motion carried (3-2).

The Legislative Committee met in Room A-209 at 8:30 A.M.

Meeting called to order by Chairperson McCulloch.

Present: Supervisors McCulloch, Pape, Wirth, Brooks, Smith, Administrative Coordinator Meaux and County Clerk Marchese.

Resolution No. 03-19 - Intergovernmental Transfer Program was reviewed and discussed. It was agreed that the fiscal impact should be shown on the support document and removed from the resolution. Motion made by Mr. Wirth, seconded by Mrs. Pape to approve the resolution, as revised. All members present voting aye, the motion was declared adopted.

Resolution No. 03-20 - Urging Enactment of Fair Utility Tax-Sharing Laws was reviewed and discussed. Changes to the resolution were made as follows: Line 22 - delete "has stifled needed development of new power generation for years" as it is repeated on line 25 and to change the word "serious" to "seriously" on line 29. Motion made by Mrs. Pape, seconded by Mr. Wirth, to approve the resolution, as amended. All members present voting aye, the motion was declared adopted.

The Legislative Committee met in Room 117 at 9:00 A.M.

Meeting called to order by Chairperson McCulloch.

Present: Supervisors McCulloch, Pape, Wirth, Brooks, Stumpe, Administrative Coordinator Meaux and County Clerk Marchese.

Absent: Supervisor Smith.

Minutes of the August 26, 2002 and January 15, 2003 meetings were reviewed. Motion made by Mr. Wirth, seconded by Mr. Brooks, to approve the minutes as mailed. Motion carried.

A resolution regarding the County Administrator Duties and Powers, Section 59.18 (2)(c) of the Wisconsin Statutes was presented and discussed. Mr. Stumpe presented some background information he has obtained from other counties. Discussion continued regarding the difference in the two positions. Motion made by Mr. Brooks, to approve the resolution for presentation to the County Board. There was no second.

Discussion continued. It was agreed to table the resolution for a future meeting.

A resolution from Racine County requesting a waiver from certain statutes requiring publication in a newspaper of certain notices. It was agreed to check each statute listed and report back at the next committee meeting.

A resolution from Jefferson County to allow law enforcement officers to stop or inspect a vehicle solely to determine compliance with the use of safety belts in motor vehicles. Motion made by Mrs. Pape, seconded by Mr. Brooks, not to consider any action on this resolution. Motion carried.

A resolution from Langlade County regarding merits of Wisconsin's Comprehensive Planning Law (Smart Growth). Motion made by Mr. Brooks, seconded by Mrs. Pape to support this resolution and to present a resolution to our County Board at their next meeting. Discussion regarding the same resolution received from Price County. A friendly amendment was made to take the first further resolved paragraph and add it to the Langlade resolution as the third whereas paragraph. Further discussion regarding the resolution. Motion made by Motion made by Mrs. Pape, seconded by Mr. Brook, to approve the resolution as amended. Motion carried.

A resolution from Rock County regarding creation of a joint survey committee on state mandates and required funding of state mandates. Discussion regarding the intent of this resolution. Motion made by Mrs. Pape, seconded by Mr. Wirth, to support this resolution and to present a resolution to our County Board at their next meeting. Motion carried.

A resolution from Monroe County regarding funding mechanism of the Land Information Department. Motion made by Mr. Wirth, seconded by Mr. Brooks, to support this resolution and to present a resolution to our County Board at their next meeting. Motion carried.

A resolution from La Crosse County regarding medicare payment inequities between states. Motion made by Mr. Brooks, seconded by Mrs. Pape, to support this resolution and to present a resolution to our County Board at their next meeting. Motion carried.

A resolution from Dunn County regarding allowable mileage reimbursement for volunteers. Motion made by Mr. Brooks, seconded by Mrs. Pape, to support this resolution and to present a resolution to our County Board at their next meeting. Motion carried.

A resolution from Forest County regarding nonconforming lakefront property. Motion made by Mr. Brooks, seconded by Mr. Wirth, to support this resolution and to present a resolution to our County Board at their next meeting. Motion carried.

Several topics were discussed and will be referred to departments, which could be affected by future legislation and presenting several resolutions to the County Board in the future.

Motion made by Mrs. Pape, seconded by Mr. Brooks, that the committee adjourn. Motion carried.

Meeting called to order at 9:05 a.m. by Chairman McCulloch

Minutes- Motion made by Pape; seconded by Wirth to approve minutes from last meeting date of August 26th. Motion passed. (3-0).

The Committee and others present discussed the following issues with the State Legislators:

· State budget issues (shared revenue information)

· Mandate waivers

· Exemption from public notice in newspapers

· Utility tax payments

· Funding for State Courts and related expenses (utilities, security, etc.)

· Filing fee for courthouse security

· IGT monies for county nursing home (Lasata)

· Aging appropriation

· Lottery credit eligibility

· State highway maintenance

· Election requirements and voter registration
